Terms and Conditions - Brian Jones Auto Leasing
The Customer will be referred to as “The Hirer” and Brian Jones Auto Leasing as “BJAL” in the following Terms & Conditions of Hire.

1. Ordering a Vehicle
Ordering a vehicle
The Hirer will be required to sign an order confirmation for all vehicle rentals. Rentals can be charged to a corporate identity or private individual subject to status. Orders are made by car group and are subject to availability. BJAL may supply an alternative model to those listed. BJAL will make every effort to provide the vehicle on the requested date, however, delivery dates cannot be guaranteed. BJAL will not be liable for any losses as a result of delivery not being made on the specified date.
Minimum Rental Period
The minimum rental period is 6 months. We are sometimes able to accommodate shorter rental periods. Please contact us to discuss your requirements.
Ordering Deposit
Each vehicle rental will be subject to a deposit equivalent to six weeks initial rental. Payments then commence from week 7 by standing order until the end of the agreed rental period.
Damage Deposit
A Damage Deposit of £500 is required. This must be paid by credit card prior to delivery.
The Damage Deposit will be held by BJAL as its absolute property until the Agreement is terminated and all liabilities of the hirer have been discharged. Additional charges will be levied should any damage incurred exceed £500 in value. These charges are to be paid on demand.
Mileage Allowances
Mileage allowances are agreed at the start of the rental period. Any excess mileage will be charged for. Excess mileage charges shall be calculated on each vehicle, pro-rata for the actual period each individual vehicle is with the Hirer and shall not be amalgamated or pooled.
Rental Periods and Termination
Each vehicle will have a set rental period of at least 6 calendar months. A new Rental Agreement must be completed for each calendar month. It will be assumed the agreement is terminated at 6 months giving one calendar month's notice at the five month point. This option applies at 6 months for a 7 month rental and at 11 months for a 12 month rental. If the vehicle is under repair or off the road due to repairs or accidents, then the weekly rental charges will continue until the vehicle is in a condition to be rented or returned.
2. Delivery and Collection of Vehicles
Delivery
The vehicle will be delivered and collected by BJAL or its authorized representatives.
Delivery and inspection charges will be calculated in accordance with the published tariff. These charges will be added to the rental amount and spread over the duration of the rental.
Charges will be made for delivery outside of a 20-mile radius of Wrexham. It is the responsibility of the Hirer or their agent to inspect the vehicle upon delivery, agree the condition of the vehicle with BJAL and confirm this by signing the Rental Agreement.
Collection
All vehicles must be valeted both inside and out, prior to their final inspection. Prior to return, an independent inspection will take place. Should the interior and exterior of the vehicle be unclean, a valeting charge will be incurred. We will invoice you for any ancillary charges, which arise as a result of the final inspection as per the schedule on these Terms & Conditions.
3. Insurance
Insurance Cover
The vehicle is provided on the basis that the Hirer must provide fully comprehensive insurance for any vehicle hired from BJAL and must complete an Insurance Indemnity Form. The Hirer is to insure the vehicle for its full replacement cost. The Hirer is responsible for any losses in the event of a vehicle write-off.
BJAL will hold a copy of the Hirer's current insurance certificate on file. If the Hirer’s insurance details alter, BJAL must be notified immediately. It is the responsibility of the Hirer to keep insurance valid and up to date at all times. This includes updating the Hirer’s insurance policy if an exchange or additional vehicle is supplied.
The Hirer may opt for a rental rate inclusive of insurance subject to Conditions and Policy Excess. Details will be provided on request, and each case is considered on its individual merits. If the Hirer opts for this, BJAL will require the completion of an individual driver's proposal for each driver and a copy of each Driving Licence. Please note that BJAL cannot insure drivers under the age of 25, or any driver with 6 points or more on their Driving Licence, regardless of age.
Drivers' Licences
It is a legal requirement that BJAL must record the valid Driving Licence details for all drivers on the Rental Agreement upon delivery of a vehicle. Where a vehicle is covered by a Hirer's own insurance, it is necessary to view each individual driver's Driving Licence. It is a condition of hire that BJAL will not provide vehicles to drivers with more than 6 points on their licence, or with specific endorsements. We reserve the right to decline hire without giving reason.
4. Rates and Charges
Rates
The rates charged are for the period specified in the order confirmation. In the event of earlier termination of the agreement by either party, (the earliest period of which is after 5 months on a 6 month agreement; 6 months on a 7 month agreement and 11 months on a 12 month agreement), the Hirer will be responsible for payment of the hire and ancillary charges, for the actual period of rental. This will be in accordance with the charges schedule as published on the website at the time of the order, subject to the satisfaction of the 1 month notice period. Mileage allowances and therefore excess mileage will be calculated based upon the actual period of rental for each individual vehicle.
Ancillary Charges
Should any ancillary charge arise under the Agreement, BJAL shall, following termination thereof, first apply the Damage Deposit in satisfaction of those charges. Any balances due to the Hirer shall be reimbursed to the Hirer in full within twenty-eight days of the date of termination. Likewise, any balances due from the Hirer must be paid by credit or debit card, or cash and are payable not later than 7 days from the date of termination. Late or delayed payment of any ancillary charges will result in administration fees, and will be referred to a collection agency after 14 days. The outstanding amount will then increase by an additional 20% and all collections will be handled by the collections agency.
Ancillary charges may include, but are not limited to, excess rental days, excess mileage, unauthorized vehicle repairs, early termination, servicing costs, late payment fees and fuel as well as delivery and collection charges.
5. Practical Issues of Long-term Car Hire
Vehicle Exchange
BJAL may, given reasonable notice to the Hirer, at any time during the rental period, exchange the vehicle for an alternative of comparable class and mileage. The expense of delivering and collection of such an exchange shall be borne by BJAL. Such vehicle exchange will be at the convenience of both the end-user and BJAL but within 10 days of any request by BJAL.
Payment / Invoicing
Vehicles are supplied on a strictly non-credit basis. Payment shall be made on a 4 weekly basis, by direct debit. All Hirers will be provided with a schedule of payment within 7 days of delivery. Hirers will also be required to provide a valid credit card, if 4 weekly payments are made by credit or debit card they will attract a card payment fee of 3% (5% for American Express).
Non-Payment of Rental Fees
Failure to pay rental fees within 7 days of the due date will result in the vehicle being withdrawn from the Hirer, and the remainder of the entire rental period becoming due within 14 days. The Hirer will be fully responsible for any collection charges and impounding or release fees.
Accidental Damage
Any damage – howsoever caused - must be reported to BJAL within 4 working hours, whether covered by BJAL’s rental insurance or the customer's own insurance.
The vehicle will remain on rent to the Hirer (Lessee on the Rental Agreement) until it is repaired and in a condition to be rented out again.
BJAL will do its utmost to assist the Hirer in repairing a vehicle as quickly as possible, and at a competitive price. Our recommended repairer in the Wrexham & Chester area is Wrexham AutoKraft, in Llay, Wrexham.
If the Hirer is providing their own insurance, any charge / invoice relating to an accident such as recovery charges, road repairs etc. will be invoiced to the Hirer and will be payable within 7 days. The Hirer is responsible for reclaiming any insured losses.
Breakdowns or Accident
All BJAL vehicles are covered by the relevant manufacturer's assistance service. Should a breakdown or accident occur the driver should contact the relevant service immediately and inform BJAL of any problems.
It is the discretion of the Manufacturer as to whether a substitute vehicle will be provided. BJAL will assist where possible, but we cannot guarantee that we can provide a vehicle in these instances.
We recommend that all BJAL drivers have their own personal recovery assistance. Our preferred provider is the AA, who will provide home recovery services, dependant upon the level of cover in place.
Vehicle Maintenance
Fluid & Oil Levels
Whilst a vehicle is on hire, it is the responsibility of the Hirer to ensure all fluid levels, (oil, anti-freeze, washer fluid, brake fluid) as instructed by the vehicle handbook, are checked regularly and replenished to recommended levels when necessary. The costs of these items are the responsibility of the Hirer.
Tyres
The Hirer must also ensure that both tyre condition and pressure, are checked regularly. Replacement tyres are the responsibility of the Hirer at all times. Tyres must be replaced like-for-like and a matching pair must be on each axle. We approve Dunlop, Continental, Pirelli and Goodyear as suitable replacement tyres. =Budget and part-worn tyres cannot be fitted to the rental vehicle.
Windscreens & Glass
It is the responsibility of the Hirer to repair or replace windscreen / glass damage.
Faults
Should any fault occur in the running of the vehicle, it is the responsibility of the Hirer to notify BJAL immediately to prevent further damage.
Servicing
Because Manufacturers have increased their servicing intervals, the vehicle will not normally need any Franchised Servicing. Should a Hirer exceed the mileage allowances, the Hirer will be required to pay for a Franchised Service.
Mileage
The mileage limits are set for each vehicle in order to avoid Hirers having to pay for Franchised Servicing. Excess mileage is a serious matter and if the vehicle has excess miles, then a charge will be made.
On a 6-month rental period, if the vehicle is driven in excess of 12,000 miles on the odometer without the prior written consent of BJAL, excess mileage will be charged at a minimum of £0.50 per mile. This does not apply to vehicles hired for 30-week or 52-week periods, as they have different mileage allowances.
Parking Charges / Fines/ Impounding Costs
BJAL provides information to the Authorities with regards to any civil or criminal infringements and offences.
Any Parking Tickets, Speeding Fines, Congestion Charges & Bus Lane Offence Fines and any Impounding/Detaining/Release Costs incurred during the rental period will be the responsibility of the Hirer. Any such charges will be billed together with an administration fee of £25.00 + VAT.
The Hirer is wholly responsible for any parking charges, fines or towing, impounding, storage, release fees incurred once the vehicle is delivered and until collected by a representative of BJAL.
Any vehicles left in a car park and not returned to an agreed location will be subject to collection, towing and or parking charges as above. The Hirer will be responsible for these charges.
Permission to use within the United Kingdom Mainland Only
BJAL does not allow its vehicle to be taken off the UK mainland. Vehicles may not be taken outside of the United Kingdom mainland and may not be driven on the Continent.
6. Damage, Repair and Payment
Collection Inspection
BJAL expect that their vehicles will be returned in a saleable condition. The Hirer is solely responsible for any refurbishment costs identified by the independent vehicle inspector at the end of the BJAL rental period. No debate will be entered into, and the required repairs will be invoiced to the Hirer for settlement within 7 days as previously described in the section
Ancillary Charges.
Due care and diligence during the rental period can save time, money and frustration. The most common charges are as follows - all prices are plus VAT.
